What Is This Settlement About?
The lawsuit alleged that Kaiser Foundation Health Plan, Inc. placed tracking code on authenticated webpages where patients log in to view medical records, schedule appointments, or message doctors. The complainants alleged that Kaiser embedded session replay code from Quantum Metric and advertising pixels from Google, Bing, and Adobe on these secure portal pages, sharing member data with third-party advertisers in violation of state privacy laws. Kaiser denies all allegations and denies any wrongdoing. The Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and burden of continued litigation.
Who Is Eligible?
You may qualify for a payment if you meet all of the following criteria:
- You were a Kaiser Permanente member in California, Colorado, Georgia, Hawaii, Maryland, Oregon, Virginia, Washington, or the District of Columbia
- You accessed authenticated pages of Kaiser Permanente websites or mobile applications (pages that require a login)
- Your access occurred between November 2017 and May 2024
You do not need to prove that your specific data was shared. If you were a member and used the portal during the class period, you are eligible.
How Much Can You Receive?
Each class member who submits a timely and valid claim form is estimated to receive between $20 and $40. Class members who were Kaiser Permanente members for a longer period of time during the class period may receive a larger share of the settlement fund. Final amounts depend on the total number of valid claims filed.

What Happens If I Do Nothing?
If you do nothing, you will not receive a payment, but you will still be bound by the settlement and will release your claims against Kaiser Foundation Health Plan related to the allegations in this case. You will give up your right to sue Kaiser separately over the same privacy issues.
Can I Opt Out?
Yes. The deadline to opt out is March 12, 2026. Your written exclusion request must be postmarked by that date. If you opt out, you will not receive payment but you keep your right to sue Kaiser separately over the same claims.
