SunTrust (Truist) $240 Million Overdraft Fee Class Action Settlement: Up to $1,000 Per Customer

SunTrust Bank (now Truist) has agreed to pay $240 million to settle a class action lawsuit alleging the bank illegally charged overdraft fees on ATM and debit card transactions. Eligible Georgia customers could receive up to $1,000 depending on their overdraft history.

Claim forms will be mailed or emailed to eligible Settlement Class Members after final court approval (hearing: May 26, 2026).


What Is This Settlement About?

The class action alleged that SunTrust Bank charged overdraft fees on ATM and debit card transactions in violation of federal regulations. Under Regulation E, banks must obtain a customer’s affirmative consent before charging overdraft fees on these types of transactions. The lawsuit claimed SunTrust either failed to obtain proper consent or used misleading opt-in practices.

This case has been litigated for over 15 years, making it one of the longest-running overdraft fee class actions in the country. Truist Financial Corporation, which was formed from the merger of SunTrust and BB&T in 2019, took an earnings hit to fund the settlement.

Who Is Eligible?

You may qualify if you:

  • Were a Georgia citizen with a SunTrust bank account
  • Had an account that was not closed before June 1, 2010
  • Were charged at least one overdraft fee of $500 or less on an ATM or debit card transaction between July 12, 2006 and April 15, 2014

How Much Can You Receive?

Individual payouts are estimated at $5 to $1,000 depending on how many qualifying overdraft fees you were charged during the class period. The more fees you paid, the higher your share of the settlement fund.

  • Claim Deadline: Expected August 2026 (after final approval)
