What Is the Labcorp AMCA Data Breach Settlement?
The case, In re: American Medical Collection Agency, Inc. Customer Data Security Breach Litigation (No. 19-md-2904), is pending in the U.S. District Court for the District of New Jersey. It concerns a cybersecurity incident at AMCA — a third-party billing and collections vendor — between approximately August 1, 2018 and March 30, 2019, when an unauthorized party had access to AMCA systems containing personal and protected health information Labcorp had transmitted to AMCA. Labcorp denies any wrongdoing.
Who Qualifies?
The Settlement Class includes all individuals for whom Labcorp transmitted personal information to AMCA that was contained in the systems implicated by the breach. Most class members were sent a notice with a unique Class Member ID by email or mail. If you received that notice, you are very likely a class member.
How Much Can You Get?
Option 1 — Alternative Cash Payment (estimated $50, no documentation): a flat, pro rata payment requiring only your Class Member ID.
Option 2 — Out-of-Pocket Losses (up to $5,000, documentation required): reimbursement for unreimbursed costs traceable to the breach, including identity-theft losses, professional service costs, miscellaneous expenses, credit-monitoring costs (on or after August 1, 2018), and up to 10 hours of lost time at $25/hour.
Plus two years of medical monitoring (no documentation): every class member may also enroll in up to two years of CyEx Medical Shield Pro, in addition to a cash option.
$50 Cash vs. Up to $5,000 — Which Should You Pick?
If you have no specific losses to document, the Alternative Cash Payment is the practical path — just your Class Member ID and a few minutes, plus the free monitoring. If you spent money or lost time because of fraud or misuse traceable to the breach, the Out-of-Pocket Losses option can recover far more, but requires receipts, statements, and a signed attestation.
