OptumHealth Ordered to Remain in Opioid Lawsuits by Federal Judge

Federal Judge Dan Aaron Polster ordered three OptumHealth health-services affiliates to stay as defendants in federal opioid lawsuits on Oct. 15, 2026. He denied their dismissal motions in two pharmacy-benefit manager bellwether cases.

A pharmacy-benefit manager, or PBM, handles drug price talks and formulary lists for health plans. A bellwether is a test case that helps assess wider litigation theories. The cases sit in the consolidated National Prescription Opiate Litigation in the Northern District of Ohio.

Which OptumHealth companies remain defendants?

Law Commentary identifies the defendants as OptumHealth Care Solutions LLC, OptumHealth Holdings LLC, and Optum Health Networks Inc. in its Oct. 20 report. All three are UnitedHealth Group and Optum affiliates. The order issued in Case No. 1:17-MD-2804 as Doc.

No. 6742 on Oct. 15, 2026. The National Prescription Opiate MDL official order site published the full order. These firms sit in Optum's health-services arm. They are separate from OptumRx, the pharmacy-benefit manager that had already accepted the Ohio court's jurisdiction.

Why can Ohio hear claims against out-of-state firms?

Law360 reports the court found personal jurisdiction over the three out-of-state companies for federal RICO claims in its Oct. 15 coverage. RICO is the federal racketeering law at issue here.

Its nationwide service rule can allow a federal court to hear related state-law claims too. The judge distinguished the Sixth Circuit's June 16, 2026 Hall v. Trivest Partners decision, described in the Justia opinion summary. He found no single alternative court could use traditional jurisdiction over all dispersed defendants in the alleged scheme.

What do the lawsuits allege about PBMs?

According to Law Commentary, plaintiffs allege PBM-linked businesses used formulary placement, price talks, and rebate leverage to boost opioid prescribing, distribution, and sales. Formulary placement means a drug's position on a covered-drug list.

Rebate leverage means using discounts to gain favorable placement. The Optum defendants dispute those unproven allegations. The ruling tests only whether the claims can proceed, not whether they are true.

Can consumers file a claim now?

This decision is procedural only. It does not find that the OptumHealth companies caused opioid misuse or face liability. It creates no payment path by itself.

For readers watching compensation issues, practical limits matter. No action guarantees payment at this stage. Bellwether results often shape later talks, but they do not guarantee broader relief. The companies must now defend the bellwether cases testing PBM-related theories.

  • Watch bellwether progress before expecting any payout.
  • Keep personal pharmacy or treatment records in one place.
  • Avoid services that charge now to file an opioid claim.
