The case, Boi v Aldi Foods Pty Ltd, is a class action. That means one court case resolves shared claims for a large group of workers.

According to HR Director Australia, about $26.3 million plus interest remains payable under the settlement method, with $1.5 million toward SDA legal and project costs HR Director settlement breakdown. That structure matters for expectations. A worker with many unpaid shifts can receive more than a worker with few. The total cannot be divided evenly across the group.

The SDA Union reports about 32,300 current and former staff are covered by the claims. Justice McElwaine approved the settlement on 23 October 2026.

- Performed work before or after a rostered shift without pay

How is each payment calculated?
No published flat amount exists. According to the SDA Newcastle class action page, each payment is calculated individually for unpaid hours plus superannuation plus separate interest under an agreed formula and Distribution Scheme SDA Newcastle ALDI class action page. Unpaid minutes therefore matter more than job title.
Longer pre-shift setup, late customer service, cleaning, cash handling or close-down work can raise the amount. Workers keep the full calculated entitlement. No legal fees or litigation-funding commissions come out of settlement payments. The three lead applicants, Kelly Boi, Souad Tannous Lichaa and Harinder Pal, each receive a $10,000 reimbursement payment on top of individual compensation.
When will payments arrive?
ALDI must calculate entitlements and make settlement payments by 31 March 2027, or before dismissal of the proceedings if that date is later. According to OnNotice workplace news, affected workers should keep contact and payroll details current so payment can reach them OnNotice settlement approval report. Former employees need this step most.
Old addresses, closed bank accounts and changed surnames are common reasons for delayed remediation pay. If details have changed, update them with ALDI or the contact point supplied in settlement communications. Keep payslips, rosters and employment dates where available.
