PFAS Lawsuit Against Chemical Manufacturers: What Is the Filing Deadline?

There is no single nationwide filing deadline for PFAS lawsuits against chemical manufacturers. The deadline for a personal-injury suit is set by each state's tort statute of limitations, according to Goldwater Law Firm in its PFAS FAQ. PFAS cases are claims that manufacturers such as 3M and DuPont are responsible for contamination and related illness. That means timing turns on where you file and what kind of claim you bring.

How much time does your state allow?

State personal-injury limits generally range from 1 to 6 years, with most states allowing about 2 years. A late filing can cause dismissal even with a strong claim, according to Goldwater Law Firm in its PFAS FAQ.

Many states apply a "discovery rule." Lawsuit Informer described the rule on June 1, 2026. The clock starts when the person discovered the illness and its link to exposure. It also starts when the person reasonably should have made that discovery.

Where are federal PFAS cases grouped?

Federal AFFF/PFAS cases are consolidated as MDL No. 2:18-mn-2873-RMG. The case is In re Aqueous Film-Forming Foams Products Liability Litigation. It proceeds in the U.S. District Court for the District of South Carolina, according to the official settlement program site in its 3M home page.

That MDL proceeds before Judge Richard M. Gergel. It includes municipal water-provider claims. It also includes thousands of individual personal-injury claims against 3M, DuPont and others, according to the MDL Update Oct. 2026 status page.

What are the water-settlement claim dates?

The 3M public-water-system settlement received final court approval in April 2024. It will pay $10.5 billion to $12.5 billion for drinking-water contamination, according to Legal Dive on April 4, 2024. For Phase Two water systems, the court's Dec.

15, 2025 order sets two dates. Testing Compensation claims are due March 31, 2026. Action Fund claims are due July 31, 2026 in both the 3M and DuPont settlements, according to the official settlement documents site in the court's Dec. 15, 2025 order.

Does a settlement extend your injury deadline?

No. Water-system settlement deadlines do not extend personal-injury statutes. Individuals and utilities should verify their own state or settlement-phase deadline and preserve medical, testing and water records, according to PublicCEO in March 2026. EPA designated PFOA and PFOS, including salts and isomers, as CERCLA hazardous substances in April 2024. CERCLA is the federal Superfund cleanup law. The designation was published May 8, 2024 and enables Superfund cleanup liability and release reporting, according to the U.S. EPA factsheet. The D.C.

Circuit upheld the designation on Aug. 18, 2026. The case was Chamber of Commerce v. EPA, No. 24-1193, according to the Mondaq/Hodgson Russ summary from Aug. 2026. That ruling preserves manufacturer cleanup exposure but does not add time to file an injury claim. Check your state's limit now and keep those records together.

  • Confirm your state's injury filing limit and discovery rule.
  • Confirm whether any water-system claim has a separate phase deadline.
  • Save medical visits, lab tests and water records together.
