People in Canada who became ill after drinking one of the Silk or Great Value plant-based beverages recalled in July 2024 can file in the Silk recall settlement until October 16, 2026 at 11:59 p.m. Pacific Time — and at the lowest payment levels, a solemn declaration takes the place of a receipt. There is no notice ID, claim ID or PIN, and you do not need to have received a mailed notice. What the settlement does require is illness: every payment level is tied to symptoms, so buying a recalled carton without having any symptoms does not earn a payment here.
Status: Final approval granted April 17, 2026 — claims open | Claim deadline October 16, 2026, 11:59 p.m. Pacific Time | $400 to $300,000 CAD by injury level | No receipt for symptoms that lasted up to one week
The No-Receipt Route: A Solemn Declaration
This settlement does not hand out claim numbers. The class is open to anyone in Canada who bought and drank a recalled product, so there is nothing to look up from a notice before you start the claim form.
For the lowest compensation levels — the $400 and $1,500 levels, which cover symptoms that lasted up to one week — you can file on a solemn declaration alone. In it you attest that you bought and drank a recalled product, and you describe your symptoms. No receipt and no medical records are required at those levels.
One condition comes with it. If you no longer have a receipt or the saved packaging, the claim form lets you check the solemn declaration in place of those records only where the illness occurred within the incubation window the settlement uses: at least 48 hours and no more than 70 days after you drank the product. Above one week of symptoms, the declaration is no longer enough on its own, and the paperwork requirements change sharply (see the table below).
It Pays for Illness, Not for the Carton
This is the point most likely to trip people up. Compensation in the Silk recall settlement is tied to illness or exposure, not to the purchase itself. Every payment level requires symptoms consistent with listeriosis, or a related psychological diagnosis, following consumption of a recalled product.
If you bought a recalled carton and simply want your money back, and you did not become ill, the settlement claim is the wrong route. Refunds are handled separately through Danone Canada’s Voluntary Refund Program, not through this claim form.
Six Payment Levels and the Proof Each One Needs
All amounts are in Canadian dollars. The level is set by how long your symptoms lasted and whether you were hospitalized.
| Level | Payment (CAD) | What you must show |
| Symptoms consistent with listeriosis lasting up to 48 hours, and/or symptoms consistent with a psychological condition caused by exposure to a recalled product | $400 | Solemn declaration; no receipt, no medical records |
| Symptoms lasting more than 48 hours and up to one week | $1,500 | Solemn declaration; no receipt, no medical records |
| Symptoms lasting more than one week, without hospitalization | $7,000 | Contemporaneous medical records |
| Hospitalization with no complications or permanent symptoms | Up to $30,000 | Contemporaneous medical records |
| Hospitalization with complications or permanent injury | Higher amounts (the .com page gives no figure) | Contemporaneous medical records |
| Claim involving the death of a loved one | Up to $300,000 | Contemporaneous medical records, which can include a death certificate, plus proof of the family relationship |
For the higher levels, the records that count include physician notes, hospital admission and discharge records, lab or whole-genome-sequencing confirmation of Listeria monocytogenes, or a death certificate. A claim made for a family member also needs evidence of the family relationship. Special-damages claims — medical, transportation or funeral costs — need receipts and proof of payment, so the no-receipt route does not extend to out-of-pocket expenses. Send only the documents the official claim package and compensation grid ask for.
The settlement fund is fixed. Final amounts may be adjusted depending on the number and severity of valid claims, so the figures above are not guaranteed payments. The official compensation grid on the settlement website sets out the exact criteria and evidence for each level.
Which Drinks Were Recalled, and Who Is in the Class
The recall, initiated by Danone Canada on July 8, 2024, covered plant-based refrigerated beverages sold under the Silk and Walmart Great Value brands in almond, oat, coconut, cashew and combination flavours. Recalled cartons are identified by their best-before dates and the 4-digit product code 7825.
The class is every person in Canada who purchased or ingested one of those recalled products, including anyone who suffered a personal injury as a result, together with their successors, assigns, family members and dependants. Family members and estate representatives have a narrower path, though. They can claim only when the person who drank the product qualifies at the hospitalization-with-complications level or the death level.
This is a Canadian settlement. It covers people in Canada only, its dollar figures are Canadian dollars, and it does not apply to purchases made in the United States.
The Listeria Outbreak Behind the Case
The beverages were recalled after they were linked to an outbreak of Listeria monocytogenes. Public health authorities reported 20 illnesses, 15 hospitalizations and three deaths connected to the outbreak.
The class action, Romano v. Danone Inc., No. 500-06-001321-245, was heard in the Superior Court of Québec in Montréal. The court approved a $7.5 million settlement, a figure stated net of provincial health insurer claims, legal fees and expenses, and final approval was granted on April 17, 2026. The defendants — Danone Canada, Walmart Canada and Intact Insurance Company — agreed to settle without any admission of wrongdoing or liability. Concilia Services Inc. is the claims administrator and is accepting claims now.
How to File Before October 16
- Open the claim form on the official settlement website, plantbeverages-settlement.com. The site also posts the full compensation grid and takes document uploads.
- Choose the level that matches how long your symptoms lasted and whether you were hospitalized.
- For symptoms that lasted up to one week, complete the solemn declaration. For any higher level, upload the medical records the grid asks for.
- Submit the completed Claim Package — the claim form plus any required supporting evidence — to the claims administrator on or before October 16, 2026 at 11:59 p.m. Pacific Time.
Filing is free, and you do not need a lawyer to submit a claim. Be wary of anyone who contacts you asking for a payment or banking details to “release” a settlement payment; the legitimate process runs only through the official settlement website. No payment date is given on the Silk and Great Value settlement page on OpenClassActions.com, which our sister site updates as the case moves forward.
Frequently Asked Questions
Do I need a receipt to file in the Silk recall settlement?
Not at the lowest levels. If your symptoms lasted up to one week (the $400 and $1,500 levels), you can file on a solemn declaration that you bought and drank a recalled product, describing your symptoms, with no receipt and no medical records. The declaration can replace a missing receipt or packaging only where the illness occurred at least 48 hours and no more than 70 days after you drank the product. Higher levels require contemporaneous medical records.
What is the deadline to file?
Your completed claim package must be submitted to the claims administrator through the official settlement website on or before October 16, 2026 at 11:59 p.m. Pacific Time.
I bought a recalled carton but did not get sick. Can I claim?
Not through this settlement. Every payment level requires symptoms consistent with listeriosis, or a related psychological diagnosis, after drinking a recalled product. Refunds for recalled products are handled separately through Danone Canada’s Voluntary Refund Program.
Do I need a notice, claim ID or PIN?
No. There is no notice ID, claim ID or PIN, and you do not need to have received a mailed notice. The class is open to anyone in Canada who bought and drank a recalled product.
How much can I get?
Payments are in Canadian dollars and depend on the injury level: $400 for symptoms up to 48 hours, $1,500 for more than 48 hours up to one week, $7,000 for more than one week without hospitalization, up to $30,000 for a hospitalization without complications, higher amounts for a hospitalization with complications or permanent injury, and up to $300,000 for a claim involving a death. Because the fund is fixed, final amounts may be adjusted based on the number and severity of valid claims.
Can people in the United States file?
No. This is a Canadian settlement approved by the Superior Court of Quebec, and it covers persons in Canada only. It does not apply to U.S. purchases.
