Companies that bought MDI or TDI straight from the manufacturer since 2016 have three claim deadlines in the $37.65 million diisocyanates price-fixing settlements, and the first one — October 13, 2026, for the Wanhua settlement — is less than two weeks away. A buyer that has never filed should work to that earliest date. The good news is that one filing carries forward: a company that already submitted a Claim Form in connection with an earlier settlement in the case does not have to file again.
Status: Claims open, fairness hearing December 7, 2026 | Claim deadlines October 13, October 19 and November 2, 2026 | Pro rata share of $37,650,000 | Class Member ID needed to file online
Five Settlements, Three Deadlines
The litigation is In re: Diisocyanates Antitrust Litigation, Master Docket Misc. No. 18-1001, MDL No. 2862, in the U.S. District Court for the Western District of Pennsylvania. Every company named as a defendant has now settled. Each settlement group has its own deadline, and each date is also the cutoff to exclude yourself from, or object to, that settlement:
| Wanhua Chemical (America) | $7,750,000 | Claim, exclusion and objection deadline October 13, 2026 |
| Dow and Huntsman International | $14,000,000 and $6,000,000 | October 19, 2026 |
| BASF Corporation and Covestro LLC | $2,900,000 (plus $100,000 toward notice) and $7,000,000 | November 2, 2026 |
The Dow and Huntsman agreement, executed July 29, 2026, is the most recent and the largest. The notices give dates only, with no cutoff time or timezone. Exclusion requests can be revoked in writing, keeping the company in the class, if the revocation reaches the administrator by December 3, 2026.
The Allegation
The plaintiffs allege that the manufacturers conspired to fix prices and restrict the supply of methylene diphenyl diisocyanate (MDI) and toluene diisocyanate (TDI) sold in or shipped to the United States, in violation of Section 1 of the Sherman Act. According to the complaint, the scheme ran through coordinated price-increase announcements and planned manufacturing shutdowns that tightened supply.
Each settling defendant denies the allegations and any liability or wrongdoing. The settlements were reached to avoid the cost and risk of further litigation, without any admission, and the court has not ruled on the merits.
Direct Buyers Only
MDI and TDI are industrial building blocks, not retail products. They are reacted with polyols to make polyurethane. MDI goes mainly into rigid and semi-rigid foams and plastics — building insulation, refrigeration and appliances, auto parts, shoe soles — while TDI is used mostly for flexible foam in mattresses, furniture cushioning, automotive seating and packaging. Buyers are manufacturers, formulators, systems houses and distributors taking the chemical by drum, tote, tank truck or railcar.
The classes cover persons and entities in the United States, its territories and the District of Columbia that bought or received MDI or TDI directly — including through controlled subsidiaries, agents, affiliates or joint ventures — from the defendants, from Covestro AG, Wanhua Chemical Group Co., Ltd., Mitsui Chemicals, Inc., Mitsui Chemicals America, Inc., MCNS or MCNS Polyurethanes USA Inc., or from their subsidiaries, affiliates or successors. Every grade and trade name counts, whether invoiced as polymeric MDI, pure MDI, a TDI isomer blend or a branded product.
A company that bought foam, insulation, coatings or finished goods made with these chemicals is an indirect buyer and is not in the class. Neither are consumers who bought a foam mattress or sofa. Also excluded: the defendants and alleged co-conspirators and their affiliates, government entities, the presiding judicial officers and their families and staff, any assigned juror, and anyone who validly opts out.
The Class Period Ends Differently for Each Settlement
All classes start on January 1, 2016, but each runs through the date that particular settlement was signed:
- BASF — through April 2, 2026
- Covestro — through May 8, 2026
- Wanhua — through July 9, 2026
- Dow and Huntsman — through July 29, 2026
The Claim Form Arrives Pre-Filled
Filing online starts at a login screen on the official Diisocyanates Antitrust Litigation website that requires the Class Member ID printed on the Class Notice. Kroll Settlement Administration mailed those notices to purchasers it identified from the defendants’ transaction records. A company that cannot find its ID, or needs a Claim Form, can request it through the same website.
The Claim Form already lists the MDI and TDI purchase amounts that the defendants’ records show for that company. That shapes what a purchasing or finance team needs to do:
- If the printed amounts look right, no supporting documents are needed. Complete, sign and submit the form, which covers payment selection, class member information, the purchase figures and an attestation signed under penalty of perjury.
- If they are too low or incomplete, file a Purchase Audit Request Form with records such as purchase orders or sales receipts. Without it, payment is calculated from the amounts printed in the notice.
How Payments Are Calculated
No per-claimant estimate has been published, and none can be worked out in advance. The five settlements add up to a $37,650,000 fund. Before anything is divided, the court will consider class counsel’s request for fees, costs and expenses of up to one-third of the fund, plus service awards of $25,000 per class representative from the BASF and Covestro settlements and $15,000 per class representative from the Wanhua and Dow and Huntsman settlements, along with notice and administration costs. The court may award less.
The remaining Net Fund is split pro rata under the court-approved Plan of Allocation, according to each claimant’s MDI and TDI purchase volume. Big-volume buyers will receive more; small buyers should expect a correspondingly small payment.
Objections and the December Hearing
Objections go to the Clerk of Court for the Western District of Pennsylvania, with copies to class counsel, the settling defendants’ counsel and the administrator, by the deadline for the settlement involved. They must identify the case, state specific grounds, include proof of class membership, say whether the objector will appear, and be signed.
Judge W. Scott Hardy holds the fairness hearing on December 7, 2026 at 1:00 p.m. ET in Pittsburgh, and the date can change without further notice. Payments under the Plan of Allocation begin only after approval is final and any appeals are resolved, and no payment date had been announced as of September 13, 2026. The diisocyanates settlement page on OpenClassActions.com embeds the long-form notices for each settlement.
Frequently Asked Questions
What is the first deadline in the MDI and TDI settlements?
October 13, 2026, for the Wanhua Chemical (America) settlement. The Dow and Huntsman deadline is October 19, 2026, and the BASF and Covestro deadline is November 2, 2026. A buyer that has not filed should file by the earliest deadline that applies to its purchases.
Do I need to file separately for each settlement?
No. A class member that already submitted a Claim Form or Purchase Audit Request Form in connection with an earlier settlement in the case does not need to file again for the later ones.
Do I need purchase records to file?
Only if you disagree with the amounts. The Claim Form is pre-filled with the MDI and TDI purchases shown in the defendants’ records. To change or add to them, file a Purchase Audit Request Form with records such as purchase orders or sales receipts.
I lost the Class Member ID. Can I still file?
The online portal requires the Class Member ID from the Class Notice. A company that cannot find it can request a replacement through the official settlement website.
Are companies that bought polyurethane foam or insulation included?
No. Only direct purchasers of MDI or TDI from the defendants and the other manufacturers named in the class definition qualify. Buying products made with those chemicals does not count.
How much will my company receive?
No estimate has been published. Each approved claim receives a pro rata share of the Net Fund, after court-approved fees, costs, service awards and administration, based on MDI and TDI purchase volume.
