The Fairchild Medical Center pixel tracking settlement covers a closed list of about 1,000 California patients, and each approved claim is expected to pay a flat $25 that does not shrink no matter how many others file. The online claim form needs the LoginID and PIN printed on the notice, but a signed paper form can be mailed without them. Claims are due November 2, 2026. A year of CyEx Privacy Shield Pro comes to every class member with no claim at all.
Status: Claims open | Claim deadline November 2, 2026 | Opt-out and objection deadline September 28, 2026 | $25 per approved claim plus one year of CyEx Privacy Shield Pro
A Short List of Class Members
The court defined the class as all California citizens whose private information was disclosed by Siskiyou Hospital, Inc., doing business as Fairchild Medical Center, to third parties through the Meta Pixel and related technologies without authorization. The notice puts that group at approximately 1,000 individuals.
Membership comes from the hospital’s own records. The settlement administrator, Simpluris, was given a class list, and the notice went to the people on it. That is different from settlements where anyone who visited a website can self-identify.
Excluded are the assigned judge and the judge’s family and staff; Fairchild Medical Center and its officers, directors and related companies; anyone who validly opts out; the legal representatives, successors or assigns of excluded people; and the attorneys for the parties.
Why the $25 Is Fixed
There is no common fund here. The settlement agreement requires Fairchild Medical Center to pay $25.00 multiplied by the number of approved claims, within 20 days after the settlement becomes effective. An earlier draft of the claim form had language about the amount rising or falling with the number of claims, but the final notice and the live settlement website both state a flat expected $25.00.
Attorneys’ fees and costs of up to $100,000, a service award of up to $2,500 for the class representative, and administration costs are paid by the hospital separately, so none of them come out of the $25.
| Payment options | PayPal, Venmo, Zelle, virtual prepaid card or physical check. Check is the default if you do not choose. |
| Check expiration | A check not cashed within 120 days of issuance is forfeited. |
| Claims allowed | One claim form, online or paper, per class member. |
The Privacy Benefit Arrives Without a Claim
Every class member is entitled to one year of CyEx Privacy Shield Pro. Enrollment codes were mailed on a postcard rather than claimed. The service is described as dark web scanning, compromised password scanning, a VPN, a password manager and other online privacy tools, plus access to a fraud resolution agent. Enrollment instructions are due within 20 days after the effective date, and the subscription does not activate until approval is final. The settlement website has a separate login for requesting those instructions.
Filing With or Without the Login
No receipts, records or explanation of any loss are needed; the notice says so directly. The online claim form on the Fairchild Data Settlement website opens only after you log in with the LoginID and PIN from the notice mailed to you.
Without those credentials, you have two options. You can ask the administrator to resend them through the contact channels on the official website by giving your full name and mailing address. Or you can print the claim form, where the Login ID field is marked “if known,” complete and sign it, and mail it postmarked by November 2, 2026.
At minimum, a claim needs your name and contact information, the box checked for the $25 cash payment, a payment method, and your signature attesting that the information is true. If a form is materially incomplete, the administrator must notify you and give you 21 days to fix it.
Deadlines Five Weeks Apart
| September 28, 2026 | Opt out (postmarked or emailed request with the case name and number, your full name and contact information, a personal signature and a statement asking to be excluded) or object (filed with the Clerk of Court, with copies to the administrator, class counsel and defense counsel). |
| October 15, 2026, 9:30 a.m. PT | Final approval hearing, Superior Court of California, County of Siskiyou. The date and time can change without notice. |
| November 2, 2026 | Claim deadline, online or by postmark. The notice gives no cutoff time or timezone. |
The opt-out and objection date falls before the hearing so the court can consider both. The claim deadline runs past the hearing because filing a claim does not affect the court’s decision. An objection must include contact information, proof of class membership, all grounds, any objecting attorney’s details, whether you plan to speak at the hearing, a three-year history of objections in other cases, and a signature. Opting out gives up the benefits but preserves the right to sue individually.
The Case Behind It
The lawsuit is Delgado v. Siskiyou Hospital, Inc. d/b/a Fairchild Medical Center, Case No. 24CV08548, filed in July 2024. It alleged that the hospital let third-party tracking technologies, including the Meta Pixel, collect information from visitors to its web pages. The complaint pleaded negligence, breach of implied contract, invasion of privacy under the California Constitution, and violations of the California Invasion of Privacy Act, the Confidentiality of Medical Information Act, the Comprehensive Computer Data Access and Fraud Act and the Unfair Competition Law.
The court overruled the hospital’s demurrer on all counts in April 2025, and settlement negotiations ran from November 2025 into February 2026. Fairchild Medical Center denies wrongdoing and says it would have won at summary judgment or trial. The agreement calls itself a compromise, not evidence of liability.
How the Deal Could Still Unravel
The agreement lets Fairchild Medical Center terminate it if more than 75 class members opt out, and either side can terminate if the court refuses approval in any material respect. If approval is granted, the effective date is ten days after the judgment becomes final, meaning after any appeal window runs and any appeal is resolved. Cash payments and privacy enrollment instructions follow within 20 days of that date. No payment date has been announced. Our sister site has the notice and agreement on its Fairchild Medical Center pixel tracking settlement page on OpenClassActions.com.
