Asure Timeclock BIPA Settlement: Packers Sanitation Workers Est. $950+

Workers who clocked in with a finger or face scan at a Packers Sanitation Service facility in Illinois are being offered an estimated $950 to $2,800 each — but the money comes from the company that made the timeclock, Asure Software, not from their employer. The $644,105 Asure Software BIPA settlement covers timeclock use from January 25, 2017 through September 17, 2026. Claims close December 21, 2026, and filing online takes the LoginID and PIN from the mailed notice.

Status: Preliminarily approved; claims open | Claim deadline December 21, 2026, 11:59 p.m. Central (online) | Opt out or object by November 30, 2026 | Estimated $950 to $2,800 per person

Why the Timeclock Maker Is Paying

The case is Vega v. Asure Software, Inc., No. 2022-CH-00651, in the Chancery Division of the Circuit Court of Cook County, Illinois. It targets the company that made and ran the timeclock system. The lawsuit alleges that Asure disseminated workers’ biometric information, collected through Asure timeclocks used at Packers Sanitation Service (PSSI) facilities in Illinois, without first getting the written consent the Illinois Biometric Information Privacy Act (BIPA) requires.

Packers Sanitation Service is not a defendant, and the settlement releases claims against Asure and its affiliated companies. Asure denies the allegations and denies breaking the law, and the settlement is not an admission of wrongdoing. Asure does state in the agreement that it will comply, or remain compliant, with BIPA going forward, without admitting liability.

Four years of litigation first

The case was filed on January 25, 2022. The court denied most of Asure’s motion to dismiss in August 2022 and denied its motion for summary judgment in January 2024. On reconsideration in February 2025, the court ruled for Asure on the BIPA Section 15(a) claim, which concerns retention policies, but let the Section 15(d) claim over disclosing biometric data proceed. The parties then settled with the help of a retired judge acting as mediator, and the agreement was signed in August 2026. The court granted preliminary approval, and notices went out by mail.

Who Is in the Class

The class is people who used an Asure timeclock while working at a PSSI facility located in Illinois at any time between January 25, 2017 and September 17, 2026. Asure told the court the class is 2,629 people. Membership depends on using the timeclock, not on job title, and the claim form refers to both finger and facial scans used for timekeeping.

Five groups are excluded:

  • Anyone who was a member of a collective bargaining agreement (a union contract).
  • Anyone who signed a release of BIPA claims.
  • Anyone who already released these claims in a related case that was dismissed before the settlement takes effect.
  • The judge and court staff assigned to the case, and their immediate families.
  • Anyone who opts out by November 30, 2026.

The union exclusion is the one most likely to catch workers by surprise. If you worked at a PSSI site under a union contract, you are not in this class.

How the $950 to $2,800 Range Works

The notice estimates the net payment at approximately $950 to $2,800 per person. Before class members are paid, the $644,105 fund covers, subject to court approval:

Attorneys’ feesUp to 38% of the fund, about $244,760, plus costs
Service award to the class representativeUp to $5,000
Settlement administrationPaid from the fund

What remains is split equally among approved claims only, so each payment shrinks as more valid claims come in. As a rough illustration from OpenClassActions.com: with the full fee and service award approved, about $394,345 would remain before administration costs. Divided among all 2,629 class members, that is roughly $150 each. The official $950 to $2,800 range reflects the expectation that far fewer people will file.

Every approved claim receives the same amount, and each person may file only one claim, however many times they scanned in or out. The fund is non-reversionary. Any fee or service award the court trims stays in the fund for class members. Checks are valid for 120 days; uncashed checks and unclaimed money go to the Chicago Bar Foundation, or another recipient the court approves, rather than back to Asure.

What You Need to File

No pay stubs, timecards or other documents are required. Filing online requires the LoginID and PIN printed on the mailed notice; the online claim form will not open without them.

The form asks for your name, mailing address, phone number and email address, a preferred payment method — paper check, PayPal, Venmo or Zelle — and a signed certification that you used an Asure timeclock at least once while working at a PSSI facility in Illinois during the class period. A claim with false or materially inaccurate information is not paid, and the administrator screens for fraud.

A printable claim form, which has no LoginID field, can be mailed instead. Workers who never got a notice, or who lost their LoginID and PIN, can request them through the settlement website’s Contact page.

Where to File

Claims are filed on the official settlement website, AsureBIPASettlement.com, run by the administrator, Simpluris. The paper claim form, the full notice in English and Spanish, and the settlement agreement are on the site’s Important Documents page. Online claims are due by 11:59 p.m. Central Time on December 21, 2026, according to the claim form; mailed claims must be postmarked by that date.

Opt-Out and Objection Deadline Comes First

The deadline to opt out or object is November 30, 2026, three weeks before the claim deadline. Opting out means no payment, but you keep the right to bring your own case against Asure over the same claims. A class member who opts out cannot also object. The settlement website explains what each request must contain.

Final Approval and Payment

The final approval hearing is set for January 7, 2027 at 11:00 a.m. in Courtroom 2402 of the Circuit Court of Cook County in Chicago, before Judge Allen P. Walker. The notice says the date, time and format can change. The court will decide on the settlement, the fee request and the service award at that hearing.

If the court approves and no appeal is filed, the agreement calls for payments within 28 days after the settlement becomes final; the notice describes that as roughly 60 days after final approval. An appeal would delay payment, and if the court rejects the deal the case returns to litigation and no one is paid from this fund. No payment date had been announced as of October 26, 2026.
