If your mortgage servicer lost your personal data in a breach, you can claim up to $3,000 to $25,000 for documented losses, depending on the settlement. Most people without receipts receive only a small pro rata cash payment plus credit monitoring. A mortgage servicer is the company that collects your monthly payment and manages your loan account. Four recent breach settlements set different caps, cash amounts, and deadlines, so your payout depends on which breach notice you received.

Which settlements cover mortgage borrowers?
Academy Mortgage agreed to pay $1,995,000 for about 285,000 people notified about its March 2023 breach, according to Orrick InfoBytes in its settlement summary. LoanCare and Fidelity National Financial received final approval for a $5.9 million settlement over a November 2023 breach affecting about 1.3 million people.
Flagstar Bank and Bayview/Lakeview cover still larger groups. Flagstar established a $31.5 million fund for about 2.19 million people affected by two 2021 breaches, OpenClassActions reports in its Flagstar payout breakdown. Bayview/Lakeview agreed to a $26 million settlement covering 5,774,688 class members, according to National Mortgage News in its review of the Bayview deal.
How much can you claim for documented losses?
Academy offers up to $3,000 per person for documented losses. Bayview/Lakeview offers up to $5,000 per person, capped at $5 million in total for that category. Flagstar allows up to $25,000 for documented losses.
These higher amounts require receipts and fraud or costs traceable to the breach. Bank statements, credit repair bills, and identity-theft expenses count when they show dates, amounts, and a link to the breach. Without that paper trail, administrators generally deny the high-tier claim.
What do you get without receipts?
Most approved claimants receive pro rata cash. That is an equal or formula-based share of money left after fees, administration costs, and documented-loss payments. Flagstar estimated its residual cash payment at $55.11.
Academy also offers three-year monitoring plus a pro rata cash payment. Monitoring helps detect new misuse of exposed Social Security numbers and loan data. It does not replace reimbursement, so file for losses when you have them.
How do you check eligibility and file?
Start with the mailed or emailed breach notice. It names the servicer, breach date, and claim instructions. The official settlement site states that Academy claims are due Jan. 27, 2027, with a final approval hearing Mar.
31, 2027, in the Academy filing instructions. Do not confuse Mr. Cooper's $5.8 million servicing-fee payment with its separate late-2023 breach litigation. File in the case matching your notice, keep copies of receipts, and calendar the deadline printed on your notice.
