How Long Do You Have to File a Claim After a Spam Text Settlement?

You have until the filing deadline listed in your settlement notice. There is no single federal claim period for spam-text settlements.

A spam-text settlement is a class-action deal that resolves claims over unwanted marketing texts. The deal pays eligible people who received covered texts. Your time to claim depends only on that deal's court-approved deadline.

Why deadlines are different every time

Each court-approved settlement sets its own filing deadline. That date controls who gets paid under that case. The official settlement websites administered by Kroll and Angeion Group show BuyAlerts requiring claims by February 16, 2027 while Teleflora requires them by November 17, 2026 (BuyAlerts settlement information, Teleflora settlement information).

One date does not extend the other. Always use the notice for the settlement that covers your texts. A later deadline in another case does not reopen an earlier one.

What are the current cutoff dates?

The BuyAlerts TCPA Settlement Website states that a valid Claim Form is due by Tuesday, February 16, 2027. It says this is the only way to receive payment of up to $42.16 per member, limited to one form per member. The official Carter v.

Teleflora LLC Settlement Website states that class members must submit a completed Claim Form by November 17, 2026. It says qualifying claimants may receive up to $251 by check if the court grants final approval. Those amounts are caps, not guarantees. Final payment can depend on the number of valid claims and court approval.

Do your texts qualify?

BuyAlerts covers people who meet a specific pattern. The BuyAlerts TCPA Settlement Website describes people who from January 1, 2022 through August 7, 2026 received more than one BuyAlerts text in any 12-month period after replying stop or while listed on the National Do Not Call Registry. Teleflora covers a different group.

The official Carter v. Teleflora Settlement Website describes cellular numbers on the National Do Not Call Registry that allegedly received Teleflora telemarketing texts in violation of the Telephone Consumer Protection Act, which Teleflora denies. Check the date range, sender, stop request, and Do Not Call status. If one detail does not fit, that settlement does not cover that text.

How do you file before the cutoff?

File directly on the official settlement website or by mail postmarked by the deadline at no cost. Use the Unique ID or confirmation code from the mailed or emailed notice.

The BuyAlerts TCPA Settlement Website via Kroll and Teleflora Settlement Website via Angeion Group provide the official filing paths, including the Teleflora online claim form. Do not pay a third party to submit the same free form.

  • Enter the Unique ID exactly as printed in the notice
  • Complete every required field on the official claim form
  • File online or mail early enough for a deadline postmark
  • Save the confirmation page, number, or mailed copy

What happens if you miss the date?

Missing the settlement deadline means no payment. The BuyAlerts TCPA Settlement Website says doing nothing yields no payment. Submitting a claim also has a legal tradeoff. The same BuyAlerts source says submitting a claim gives up the right to sue separately, and excluding by January 4, 2027 is the only way to preserve separate suit rights.

This claim deadline is separate from time to sue. Cornell Legal Information Institute text for 28 U.S.C. §1658 bars civil actions under post-1990 federal statutes later than 4 years after accrual, while the Federal Communications Commission requires prior express written consent for marketing robotexts. Mail early so the postmark falls before the deadline.
