The headline number in the TRC Staffing data breach settlement — $200 in cash with no receipts — is a ceiling, not a promise. It is a pro rata share of a $1.7 million fund that also pays for notice, administration and the lawyers, and TRC reported 158,593 people affected by its spring 2024 breach. People sent a notice letter can take that cash, or instead claim up to $5,000 in documented losses plus lost time. Claims close December 22, 2026.
Status: Claims open, final approval pending | Claim deadline December 22, 2026 (online or postmarked) | Opt out or object by December 7, 2026 | Up to $200 pro rata, or up to $5,000 documented plus $80 lost time
Why the Cash Could Land Below $200
Everything in this settlement comes from one $1.7 million fund: class benefits, the cost of notice and administration, and whatever attorneys’ fees and costs the court approves. The alternative cash payment is calculated from what remains, split among valid claims, and capped at $200. With a class this size, the number of people who file will largely determine what each cash claimant receives. Until the administrator runs the numbers, any per-person figure is an estimate.
Pick One Route
The two options are alternatives. You cannot claim both.
| Documented losses — up to $5,000 | Reimbursement of out-of-pocket losses traceable to the data incident, backed by documentation such as receipts, bank or card statements, or invoices. Add up to four hours of lost time at $20 an hour, for up to $80 more. |
| Alternative cash payment — up to $200 | A pro rata payment with no documentation of losses required. |
If you have real costs from the breach, such as fraud losses or credit-freeze fees, and the paperwork to show them, the documented route is worth considering. Without records, the cash payment is the practical choice.
What Happened at TRC
TRC Staffing Services, Inc., which does business as TRC Talent Solutions, is a staffing company. According to its breach notice to the Maine Attorney General, as reported by Staffing Industry Analysts, an unknown party had access to TRC’s systems between March 25 and April 12, 2024. TRC identified suspicious activity, including encrypted files, on April 12. The information involved included names and other personal identifiers together with Social Security numbers. TRC began notifying people around May 24, 2024 and reported 158,593 affected.
The consolidated lawsuit, In re TRC Staffing Services, Inc. Data Breach Litigation, No. 1:24-cv-02398-VMC, is before U.S. District Judge Victoria M. Calvert in the Northern District of Georgia. It alleges TRC failed to adequately safeguard the personal information it held. In June 2025 the court granted TRC’s motion to dismiss in part and denied it in part. After a stay of discovery for mediation, on July 20, 2026 the plaintiffs filed an unopposed motion for preliminary approval of the settlement. TRC denies wrongdoing, and the court has not decided whether the claims have merit.
The Letter Defines the Class
The class is U.S. residents who were sent a notice letter about the TRC data incident. That letter is the test: people who worked with TRC but never got one are outside the class definition. The claim form ties each claim to the letter through the Class Member ID printed on it.
If you are not sure you are on the class list, ask the administrator through the official settlement website rather than assuming either way.
The Class Member ID Is Required for Every Claim
Even the no-receipts cash option requires the Class Member ID from your notice letter. The documented route adds a second layer: records for each out-of-pocket loss showing the amount and linking it to the data incident. Lost time is claimed in hours, up to four.
If you no longer have the letter, contact Kroll Settlement Administration, the settlement administrator, through the contact options on the official website before the deadline.
Deadlines
| December 7, 2026 | Last day to opt out, which preserves your right to sue TRC separately, or to object while staying in the class. |
| December 22, 2026 | Claims submitted online or postmarked. The notice gives no time of day, so file online well before midnight. |
Doing nothing means no payment and still being bound by the settlement’s release of claims against TRC over the incident.
How to File
Go to the official TRC data breach settlement website. Enter your Class Member ID, choose the documented-loss route or the alternative cash payment, and upload supporting documents if you are claiming losses. A paper claim form can be mailed instead, postmarked by December 22, 2026. The notice, settlement agreement and related filings are on the site’s documents page.
What Comes Next
The court will hold a final approval hearing to decide whether the settlement is fair, reasonable and adequate and to rule on the request for attorneys’ fees and costs. The source materials we relied on do not state the hearing date; it and any changes are posted on the official settlement website. Payments go out only if the court grants final approval and any appeals are resolved. No payment date had been announced as of September 24, 2026, according to OpenClassActions.com’s TRC Staffing settlement page.

No. You choose either documented out-of-pocket losses up to $5,000 plus up to four hours of lost time at $20 an hour, or the alternative cash payment of up to $200.
