Three bank-fee settlements need attention before year end: Navy Federal opt-outs by Nov. 9, ATM surcharge opt-outs by Dec. 11, and Florence Bank objections by Dec. 12, 2026.
A retry NSF fee is a second fee charged when the same unpaid item is submitted for payment again. Florence Bank customers need no claim form and receive payment by account credit or check. Navy Federal members keep automatic loan cancellation by doing nothing, but must file to get an extra payment. ATM users face only an opt-out deadline this year, with claims due next year.

Why do these fee cases continue?
According to the National Consumer Law Center, U.S. families paid over $12 billion in overdraft and NSF fees in 2025. That followed Congress reversing the CFPB's 2024 rule projected to save $5 billion yearly.
Continued litigation focuses on retry and authorize-positive fees. According to the Federal Trade Commission, its fee rule effective May 12, 2025 bans hidden-fee pricing only for live-event tickets and short-term lodging. It does not cap bank overdraft fees. Consumers must therefore act on each settlement's own site by its stated date.
