The Aviva Canada COVID business-interruption payout is a $150 million all-inclusive settlement approved October 16, 2026. Most class members will receive payment for exactly 30 days of business-income loss from the net fund left after fees and costs. Business interruption here means lost income after pandemic orders limited customer access or harmed public perception of a business.
The case, Nordik Windows Inc. et al v. Aviva Insurance Company of Canada, resolved denied claims on a national basis. Readers deciding whether to file need to check eligibility, payment math, and the filing route.

Who qualifies for payment?
The main group covers about 49,000 Aviva policyholders nationwide, according to the Insurance Business Canada report on the $150M settlement. Policies had to include restricted-access or negative-publicity endorsements. The business also had to suffer interruption during the pandemic.
The claims period centers on persons insured March 1, 2020 to August 31, 2021. That window defines the coverage dates for the BDO-administered fund. Check your policy declarations and renewal pages for those endorsements.
- Aviva commercial policy in force during the claims window
- Restricted-access endorsement or negative-publicity endorsement listed
- Business-income interruption tied to the pandemic period
- Not part of the separate Legion or denturist classes
How is your payment calculated?
Most members are compensated for exactly 30 days of business-income loss under the court-approved Distribution Protocol. The 30-day limit applies even if your policy stated a longer indemnity period. Your documented daily loss therefore matters more than your total shutdown length.
Payments come only from the net remainder after court-approved deductions. If valid claims exceed that remainder, individual payments may be reduced pro rata. A short closure with strong sales records can thus pay better than a long closure with weak records.
What is taken out before you are paid?
The $150 million is inclusive of fees, disbursements, Class Proceedings Fund levy, and administration costs, according to Thomson Rogers' summary of the Aviva settlement. Aviva receives a full release of the covered claims in exchange. Nothing extra is added for counsel or administration.
About $40.68 million in legal fees plus an estimated $10.2 million levy and administration costs come off first. Only the remainder flows to claimants. Expect the headline fund to shrink substantially before distribution.
How do you claim through BDO?
BDO Canada LLP is the court-appointed administrator for the $150M fund, according to the BDO notice of the settlement approval hearing. Claims administration is underway through its Aviva claims portal. Use that portal, not Aviva or your broker, to submit.
Gather your policy number, business-closure dates, and 2019-2021 income records before you start. Enter 30 days of loss exactly as the protocol requests. Keep copies of every upload and confirmation number.
What about the Legion and denturist settlements?
Two separate Aviva COVID actions were approved October 26, 2026 for $12,375,000 total, according to the Insurance Business Canada report on the Legion and denturist settlements. Royal Canadian Legion branches share $5,512,275.50.
The McCallum denturist class shares $6,862,724.50. Those funds are administered separately by MDD. Do not file a Legion-branch or denturist claim in the BDO portal for the main $150M class.
