Mesmerica Ticket Fee Settlement: Cash Window Closed, 25% Codes Are Next

The September 18, 2026 deadline to claim cash from the Moodswings ticket fee settlement has passed, so every Mesmerica, Beautifica, Astronomica and Change Worlds ticket buyer in the six covered states who did not file, opt out or object is now on the default track: a 25% discount code on a future Moodswings ticket order, issued automatically if the court approves the deal. Class members who did file a valid cash claim are in line for $2.54 to $7.12 per ticket, depending on the state, and will not get a code. Neither benefit goes out until after the December 17, 2026 final approval hearing and any appeals.

Status: Awaiting final approval | Cash claim, opt-out and objection deadline passed September 18, 2026 | Final approval hearing December 17, 2026, 9:15 a.m. | Per-ticket cash for claimants, 25% discount code for everyone else

What the Case Is About

In Oliva, et al. v. Moodswings, LLC, Index No. 628144/2025, in the Supreme Court of the State of New York, Nassau County, ticket buyers allege that Moodswings did not disclose service charges in time on tickets sold through its own ticketing websites for shows in six states. Moodswings denies violating any law. The parties say they settled to avoid the uncertainty and cost of further litigation, and the settlement is not an admission or a finding of wrongdoing. The court granted preliminary approval, and the administrator, Kroll Settlement Administration LLC, sent notices carrying individual Class Member IDs.

Who Is a Class Member

The classes cover people who bought tickets through tickets.mesmerica.com, tickets.beautifica.show, tickets.changeworlds.org or ticketshop.mesmerica.com for a Moodswings show staged in one of six states, during that state’s class period:

State where the show was heldClass periodCash per ticket (claimants only)
New YorkAugust 29, 2022 – June 20, 2025$7.12
TennesseeJuly 1, 2023 – August 26, 2025$3.70
MarylandJuly 1, 2024 – June 20, 2025$3.48
CaliforniaJuly 1, 2024 – June 20, 2025$3.37
ConnecticutOctober 1, 2023 – August 31, 2025$2.65
ColoradoAugust 7, 2024 – August 31, 2025$2.54

What counts is where the show was and when the ticket was bought, not where the buyer lives. Someone from New Jersey who traveled to a covered New York show is in the New York class. A ticket bought outside every window, or for a show in any other state, is not covered. Moodswings identified class members from its own sales records, and receiving a notice with a Class Member ID is the practical sign that you are in.

The Discount Code: What You Get for Doing Nothing

A class member who filed nothing, did not opt out and did not object receives a discount code if the settlement is approved. Its terms:

  • 25% off one future purchase of tickets from Moodswings’s websites;
  • single-use, covering one transaction for up to four tickets, or up to the number of tickets you bought during the class period if that is higher;
  • freely transferable and stackable; and
  • good for any Moodswings show in the United States, including Astronomica, Beautifica, Mesmerica, Mesmerica XL and future productions — not just shows in the six class states.

Because the code can be transferred, a class member with no plans to see another show can give it to someone who does. Its value depends entirely on the price of an order that has not been placed yet.

If You Filed for Cash

Cash claimants are paid their state’s per-ticket rate multiplied by the ticket count in Moodswings’s records, which the claim form stated. Four New York tickets come to about $28.48; a single Colorado ticket is $2.54. An approved cash claim rules out a discount code; the two are alternatives.

Payment goes by Venmo, PayPal or Zelle to the username or email address on the form, or by paper check to the mailing address on the form. According to the settlement, a claim form that selected no payment method, or left out the information the chosen method needs, results in no cash payment. Claims were signed under penalty of perjury and are subject to audit, verification and court review. Group claim forms signed by an attorney or anyone else in a representative capacity are not accepted, and the administrator may reject unsigned, duplicate or fraudulent forms.

Anyone unsure whether their claim went through, or who never found their Class Member ID, can use the contact page on the official Moodswings Ticketing Settlement website, which also posts the settlement agreement and other case documents.

What the Passed Deadline Locked In

September 18, 2026 was also the last day to opt out, to object, and to file a notice of intent to appear at the hearing. The results of those choices:

  • Opted out: no cash and no discount code, but any right to sue Moodswings separately over these claims is preserved.
  • Objected: still in the class, and still eligible for the code or a cash payment.
  • Did nothing: receives the discount code if the settlement is approved, and gives up the right to sue Moodswings over the claims the settlement resolves.

Fees and the December Hearing

There is no common fund. On August 17, 2026 class counsel filed an unopposed motion asking the court to approve $274,125 in attorneys’ fees, costs and expenses, plus service awards of $1,000 for each of the six class representatives. That request will be decided at the final approval hearing on December 17, 2026, at 9:15 a.m. in Mineola, New York. The court will also decide whether the settlement is fair, reasonable and adequate and consider any timely objections. Class members do not need to attend.

The settlement website says codes and cash will be provided only after any issues with the settlement are resolved. That means after approval and after the time for appeals runs out. If the court denies approval, or approval is reversed or never becomes final, the case goes on and no benefit is issued. No distribution date has been announced. OpenClassActions.com follows the case on its Moodswings ticket service charge settlement page, which embeds the settlement agreement.

Frequently Asked Questions

Can I still file a cash claim in the Moodswings ticket fee settlement?

No. The deadline to submit a cash claim online or postmark a paper claim was September 18, 2026. Class members who did not file, opt out or object will receive the 25% discount code instead if the court approves the settlement.

What is the discount code worth?

It gives 25% off one future purchase on Moodswings’s ticket websites, covering up to four tickets or up to the number you bought during the class period if that is more. It is single-use, transferable and stackable, and works for any Moodswings show in the United States.

How much is the cash payment for people who filed?

The per-ticket rate is $7.12 in New York, $3.70 in Tennessee, $3.48 in Maryland, $3.37 in California, $2.65 in Connecticut and $2.54 in Colorado, multiplied by the number of tickets Moodswings’s records show.

Can I get both cash and a discount code?

No. The benefits are alternatives. A class member with an approved cash claim is not eligible for a discount code.

Do I have to live in one of the six states?

No. Class membership depends on where the show took place and when the ticket was bought, not on where the buyer lives.

When will codes or payments arrive?

No date has been announced. They are issued only after the court approves the settlement at or after the December 17, 2026 hearing and any appeal period ends.
