What Is the Case About?

The lawsuit alleges Casey’s General Stores charged employees a tobacco surcharge in its health plan that discriminated based on an impermissible health factor because it did not provide a reasonable alternative standard, in violation of ERISA. Casey’s denies the allegations and denies that it is liable, and agreed to settle solely to avoid the expense, inconvenience and risk of continued litigation, without admitting any wrongdoing.

Who Qualifies?
