Progressive Insurance $1.76M Settlement — New Mexico Single-Vehicle UM/UIM Overcharges

A $1.76 million class action settlement has been reached against Progressive and its affiliated insurance companies for overcharging New Mexico drivers for “stacked” uninsured/underinsured motorist (UM/UIM) coverage on single-vehicle policies. What Is This Settlement About?

Progressive charged New Mexico drivers higher premiums for “stacked” uninsured/underinsured motorist coverage on policies that covered only one vehicle. Stacking is designed to combine coverage limits across multiple vehicles — on a single-vehicle policy, it does absolutely nothing. Yet customers paid extra for this non-functional feature for years.

Who Is Eligible?

You may qualify if you:

  • Lived in New Mexico
  • Had an auto, motorcycle, or RV policy from Progressive or its 13 affiliated companies
  • Had stacked UM/UIM coverage on a single-vehicle policy
  • Held the policy between January 1, 2009 and April 30, 2025

How Much Can You Receive?

Your refund equals the premium difference between stacked and unstacked coverage:

  • Group 1 (May 2018–April 2025): Full refund amount — payments are automatic for refunds over $10
  • Group 2 (January 2009–May 2018): Proportional share of a $37,000–$75,000 pool — claim form required

  • Group 1 (refund $10+): Automatic — no action needed
  • Group 1 (refund under $10): Must select a payment method within 90 days
  • Group 2: Claim form required through the settlement website

Important Dates
