Under BIPA, companies must provide written notice, obtain informed consent, and establish data retention and destruction policies before collecting biometric data such as fingerprints, facial scans, or hand geometry.
Who Is Eligible?
You may be eligible if you worked in Illinois and used an EasyWorkforce biometric timekeeping device (such as a fingerprint scanner) to clock in or out of work during the class period, and you were not provided with proper BIPA-compliant notice and consent forms before your biometric data was collected.
How Much Can You Receive?
Eligible class members may receive a cash payment. BIPA provides for statutory damages of $1,000 per negligent violation and $5,000 per intentional or reckless violation. The actual per-claimant payment depends on the settlement fund and total valid claims filed.
