Clackamas County Oregon Property Foreclosure Settlement
Clackamas County, Oregon has agreed to a $2,466,403.68 class action settlement in Lynch v. Clackamas County to resolve claims that the county unconstitutionally kept surplus proceeds from tax-foreclosed property sales. Following the U.S. Supreme Court’s 2023 Tyler v. Hennepin County ruling, former property owners may now recover surplus funds. File your claim by May 25, 2026.
What Is This Case About?
The lawsuit alleges that Clackamas County violated property owners’ constitutional rights by keeping surplus proceeds from tax-foreclosed property sales — meaning the county kept money from property sales that exceeded the unpaid taxes, fees, and costs owed, without paying that surplus to former property owners. This practice was ruled unconstitutional by the U.S. Supreme Court in its landmark 2023 Tyler v. Hennepin County decision.
Who Is Eligible?
You may be eligible if you (or your estate, heirs, or successors) owned, held a mortgage interest, or held any valid lien on real property that was foreclosed by Clackamas County for unpaid taxes and the redemption period lapsed between October 12, 2017 and January 12, 2024.
How Much Can You Receive?
Your payment represents the surplus proceeds — the amount your property sold for (or was retained at) above the unpaid tax debt. Exact amounts per claimant depend on the individual property surplus and how many valid claims are submitted.
