What Is This Case About?

The lawsuit alleges that the Capital One Shopping browser extension replaced content creators’ affiliate cookies with Capital One’s own affiliate cookies during the checkout process, effectively stealing commissions from bloggers, YouTubers, influencers, and other affiliate marketers who had legitimately referred customers to merchants.

Who Is Eligible?

You may be eligible if you are a U.S.-based affiliate marketer who participated in a commission program with a merchant that also partnered with Capital One Shopping during the class period of January 6, 2020 through December 18, 2025.

  • Proof Payment: 100% reimbursement of qualifying commissions received after November 1, 2023 (with documentation)
  • Alternative Payment: $20 flat payment for those who can show their publisher/affiliate IDs appear in Capital One’s data

As non-monetary relief, Capital One has committed to compliance reforms and appointment of an ombudsman for at least two years.
